  1. What Information do we collect?

Depending on how you interact with our website or otherwise in your interactions with us offline, we collect various types of information, including personal information. Information you provide to us:

  • Identifiers and Contact Information. If you subscribe to our newsletter or marketing campaigns (including SMS campaigns), or use the “Contact Us” button available in our site we will receive your contact information which could include, depending on how you contact us, your email address, first name and last name, phone number, the reason for contacting, country and postal address and any other content you share within messages when you contact us or engage with our customer service.

    • Law enforcement and legal Disclosures. Gildan may disclose your personal information to a government institution that has asserted its lawful authority to obtain the information or where Gildan has reasonable grounds to believe the information could be useful in the investigation of suspected unlawful activity, or to comply with a subpoena or warrant or an order made by a court, person or body with jurisdiction to compel the production of information, or to comply with court rules regarding the production of records and the disclosure of information, or to Gildan’s legal counsel.
    • Disclosure in Business Transactions. Gildan may also disclose your personal information as part of a potential business transaction to the other party (including as part of the due diligence process) but will require the other party to agree to protect the privacy of your personal information in a manner that is consistent with this Privacy Policy and applicable laws.

    5.Cross-Jurisdictional Transfers

    We operate a global business. By using our services and our website, you understand that we may transfer some of the information we gather to another jurisdiction than the one you reside in. In addition to Canada and any of the provinces within Canada, your personal information may be collected, used, disclosed, or stored for any purpose stated in this Policy in the United States or any jurisdiction in which our service providers operate.

    Gildan is not responsible for the privacy practices or the content of these other entities and any information that you provide to such other entities, including what information they share with us, your rights and choices on their services and devices, and whether they store information in your jurisdiction of residence or elsewhere, shall be subject to the privacy policies of the owners of such other entities.     If you are an EU or Quebec resident, non-essential including advertising cookies are deactivated by default.

    8.Information Retention

    We use and keep your personal information for as long as it is required for the purpose identified when you provided the information or as otherwise required to comply with any legal obligation. Gildan will retain and use your information to the extent necessary to comply with legal obligations (for example, if we are required to retain your information to comply with applicable tax/revenue laws), resolve disputes, enforce our agreements, and as otherwise described in this policy.

    9. Your Rights over your personal information.

    You may be able to exercise certain privacy rights. The rights available to you depend on our reason for processing your personal information and the requirements of applicable law (i.e., your rights will vary depending on where you are located). Subject to certain exemptions, your rights may include:

    1. The right to access your personal information: You may have the right to obtain from us confirmation as to whether your personal information is being processed, and to request access to your personal information.
    2. Your right to rectification: You may have the right to request that we correct any personal information about you that is inaccurate. Depending on the purpose of the processing, you also have the right to request that we complete the personal information we hold about you where you believe it is incomplete or outdated.
    3. Right to erasure: You have the right to request the deletion or de-indexation of your personal information we have collected from you, subject to certain conditions and limitations under the law.

    8. The right to lodge a complaint with your local data protection authority: Depending on your location, you may contact your local data protection authority. In Canada, you can contact the Office of the Privacy Commissioner of Canada or the relevant provincial privacy commissioner for your province of residence. We would, however, appreciate the chance to deal with your concerns before you approach the relevant privacy regulator, so please contact us first.
    9. Automated decision-making and your personal information: We may use machine learning algorithms and forms of automated decision-making. For example, we may use automated decision-making to prevent risk and fraud, to personalize your experience and make it more efficient, and to determine eligibility for certain services or features we offer on our website and through our services. Your request must: (i) provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or an authorized representative of that person; and (ii) describe the request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. We will respond to your verifiable request within any prescribed timelines. In some cases, applicable law may require us to refuse to provide you with access to some or all of the personal information we hold about you, or which we may have destroyed, erased or made anonymous in accordance with our legal obligations to retain records and best practices for the protection of personal information.

    10. Security and Risks Related to Internet

    We do not knowingly collect personal information (as defined by the U.S. Children’s Privacy Protection Act, or “COPPA”) in a manner not permitted by COPPA.     14.Additional Disclosures

    For Nevada Residents. Nevada law (NRS 603A.340) requires each business to establish a designated request address where Nevada consumers may submit requests directing the business not to sell certain kinds of personal information that the business has collected or will collect about the consumer. A sale under Nevada law is the exchange of personal information for monetary consideration by the business to a third party for the third party to license or sell the personal information to other third parties. In the request, please specify which right you are seeking to exercise and the scope of the request. We will confirm receipt of your request within 10 business days. We may require specific information from you to help us verify your identity and process your request. If we are unable to verify your identity, we may deny your requests to know or delete.

    • Right to Opt-Out. To the extent Site Owner sells your personal information as the term “sell” is defined under the California Consumer Privacy Act, you have the right to opt-out of the sale of your personal information by us to third parties at any time.
